Wave Ki Surfing, Inc., Wave Ki, Inc., and Wave Ki Pty Ltd – Terms of Service

These Terms of Service (“Terms”) govern your access to and use of www.waveki.com (the “Website”) and all related services provided by Wave Ki Surfing, Inc. (Nevada), Wave Ki, Inc. (California), and Wave Ki Pty Ltd (Australia), collectively referred to as “Wave Ki,” “we,” “our,” or “us.”
By accessing or using the Website, you agree to be legally bound by these Terms, our Privacy Policy, and any other applicable policies. If you do not agree, you must not use the Website.
1. Introduction
Wave Ki Surfing, Inc. is incorporated in Nevada, USA.
Wave Ki, Inc. is incorporated in California, USA.
Wave Ki Pty Ltd is registered in Australia.
2. Patent Pending Notice and Authorized Use of the Wave Ki Method
The proprietary Wave Ki Method is patent pending in the United States.
Only officially accredited instructors are authorized to teach or monetize this method. Unauthorized use, reproduction, or commercial exploitation is strictly prohibited and may result in legal action.
3. Intellectual Property Rights
All content, including videos, training systems, graphics, branding, and materials, is owned by Wave Ki and protected under U.S., Australian, and international intellectual property laws.
You may not copy, reproduce, distribute, or create derivative works without prior written consent.
4. Content Disclaimer
All materials are provided for educational purposes only.
While the Wave Ki Method is a proven approach, we do not guarantee specific results or performance improvements. Results vary based on the individual.
Use of the service is at your own risk.
5. Acceptable Use
You agree not to:
- Interfere with the Website or its systems
- Use scraping, bots, or automated tools
- Upload harmful or unlawful content
- Misrepresent your identity
- Violate any applicable laws
We may suspend or terminate access for violations.
6. Membership, Subscriptions, and Payments
WaveKi.com operates on a paid subscription basis.
- Subscriptions automatically renew unless canceled
- You authorize recurring billing to your payment method
- Pricing and billing intervals are presented at checkout
7. Billing, Cancellation, and Refund Policy
Subscription Billing
Subscriptions renew automatically unless canceled prior to the next billing cycle.
Cancellation Policy
Subscriptions may be cancelled:
- By emailing admin@waveki.com
To avoid renewal charges, cancellation must be received at least 48 hours prior to the billing date.
- You are responsible for submitting cancellation in time
- Late cancellations will result in charges
- No refunds will be issued for missed cancellation deadlines
Refund Policy (Digital Services)
Wave Ki provides digital content that is accessible immediately upon purchase.
- All purchases are final and non-refundable once access is activated, except where required by law
- Refund requests made within 7 days of a charge may be reviewed at our sole discretion
- Any approved refund is a goodwill exception, not an obligation
Refunds are not provided for:
- Partial billing periods
- Unused time
- Dissatisfaction or change of mind
Service Delivery Acknowledgment
You acknowledge that:
- Wave Ki is a digital educational service
- Access to the platform constitutes full delivery of the service
Subjective dissatisfaction does not qualify as a valid refund or dispute claim.
8. Chargebacks and Payment Disputes
By completing a purchase, you agree to contact Wave Ki at admin@waveki.com to resolve any billing concerns before initiating a dispute.
Duplicate Recovery Prohibited
If a refund has already been issued:
- It constitutes full and final settlement
- You agree not to initiate or pursue a chargeback
Any attempt to recover funds through both a refund and a chargeback is considered a duplicate recovery attempt.
Right to Contest
Wave Ki reserves the right to dispute any chargeback and provide evidence including:
- Platform access logs
- IP and login data
- Acceptance of Terms
- Refund history
- Communication records
9. Physical Products
Physical products may be returned or exchanged if defective and accompanied by proof of purchase.
- Return requests must be made within 14 days
- Items must be unused and in original packaging
- Return shipping is at the customer’s expense
10. Communications and Security
While we take reasonable steps to protect your information, we cannot guarantee absolute security.
You are responsible for safeguarding your account credentials. We are not liable for unauthorized access due to your negligence.
11. User-Generated Content and Social Media
By submitting content or posting about Wave Ki, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, and distribute your content.
You waive any applicable moral rights where permitted by law.
12. Indemnification
You agree to indemnify and hold harmless Wave Ki and its affiliates from any claims arising from:
- Your use of the Website
- Your violation of these Terms
- Your infringement of third-party rights

- Engagement with such services is at your own risk
Wave Ki does not endorse other surf training programs unless explicitly stated.

15. Limitation of Liability
To the fullest extent permitted by law:
- Services are provided “as is”
- We are not liable for indirect or consequential damages
- Liability is limited to the amount paid by you in the previous six (6) months

These Terms are governed by:
- Nevada law (Wave Ki Surfing, Inc.)
- California law (Wave Ki, Inc.)
- Australian law (Wave Ki Pty Ltd)
